By booking with RaR the Customer confirms that he has read, understands and accepts these Terms and Conditions and Customer Disclaimer and acknowledges that:
The Conditions apply to the Contract to the
exclusion of all other terms and conditions.
Any variation to these Conditions (including any special terms and conditions
agreed between the parties) shall be inapplicable unless agreed in writing by
RaR.
The Contract shall be formed at the time of acceptance by RaR of a booking of
an Activity by a Customer and payment of the deposit/full cost by that Customer.
All customers must have a fully road legal motorcycle, which includes but is not
limited to Driving Licence, Road Tax, Insurance, MOT certificate and suitable
helmet.
RaR reserves the right to change the locations due to weather conditions and
the standard of the Customer/Customer's equipment and will inform the Customer
of any changes prior to the commencement of the Activity.
None of the provisions of the Conditions are intended to or will operate to
confer any benefit on a person who is not made a party to the Contract.
Acknowledgement of the risks
I understand that by taking part in this event I am exposed to a risk of death,
becoming permanently disabled or suffering some other serious injury and I
acknowledge that even in the event that negligence on the part of RaR, or any
individual carrying out duties on their behalf were to be a contributory cause
of any serious injury I may suffer, the dominant cause of any serious injury
will always be my voluntary decision to take part in a high risk activity. I have
read the above and acknowledge that my participation in this motorcycling event
is entirely at my own risk.
Participant Behaviour
The days that we run are designed for the maximum enjoyment of all riders. Our
days are not designed as ‘a race’ and as such we ask all participants to
behave in a responsible and courteous manner to all other riders and the public.
Participants that are found to be riding in an irresponsible or dangerous manner
will be cautioned and if this behaviour continues we will call an end to the
participants day without refund. Any riders found to be under the influence of
alcohol or drugs will be refused participation without refund. Guidelines are
typically, but not limited to, The Highway Code, the TRF guidelines, the Country
Code, and a principle of minimum impact.
Freewill
You understand that your participation in a RaR day is completely optional and
undertaken at your own risk. You understand that any instruction, guidance or
suggestion of any type is given in good faith, is optional, and the
responsibility for any and all of your actions remains with you.
Personal accident
Riders are not covered by our insurance for any damage or loss or personal
injury that they may inflict on themselves or others.
Refunds & Cancellations
Deposits are non-refundable and only transferable at our discretion. Your
commitment to RaR starts six weeks prior to riding with us, even if you have
not paid your final balance in full. If you cancel after this date you will be
invoiced for any outstanding balances - this is to protect us and allow us
enough time to fill the dates that you have committed to.
4-6 weeks prior to your activity - 50% refund.
2-4 weeks prior to your activity - 25% refund.
0-2 weeks prior to your activity - no refund.
Please note that if you are paying a balance on the day, we may not have
facilities to accept cheques or credit cards. Payments must be settled in full
on arrival in cash before riding commences.
If you decide to cut short your day with us for any reason or do not turn up on
a particular day on a multi day event, RaR are not at liberty to offer a
refund or organise another day for your tour.
Force Majeure
Neither party shall be liable for any default due to any act of God, war,
strike, lockout, industrial action, fire, flood, drought, tempest, or other
event beyond the reasonable control of either party.
Miscellaneous
All headings are for ease of reference only and shall not effect the
construction of the Conditions.
Any provision contained in the Conditions which is or may be void or
unenforceable shall to the extent of such invalidity or unenforceability be
deemed severable and shall not effect any other provisions of the Conditions.
Law and Jurisdiction
The Conditions and the Contract shall be governed by English Law and the
Customer consents to the exclusive jurisdictions of the English Courts in all
matters.
